Terms and conditions

By making payment, confirming a booking, or boarding the vessel, the charterer (“Client”) and all passengers agree to these Terms. Acceptance of these Terms constitutes a binding contract.

1. Booking Confirmation

1.1 A booking is confirmed only when:

Full payment has been received

1.2 The Company’s records, including booking confirmations, payment records, vessel logs, crew reports, GPS tracking, and passenger manifests, shall constitute conclusive evidence that the service was provided.

2. Payments, Authorization & Cardholder Responsibility

2.1 The person making payment confirms that they are:

The authorized cardholder; or

Fully authorized by the cardholder to complete the transaction.

2.2 Any payment made using the Company’s payment link, invoice, or online system constitutes explicit authorization for the transaction.

2.3 Claims of “unauthorized transaction” or “fraud” after service delivery shall be deemed invalid unless proven otherwise.

2.4 All payments are non-refundable except as expressly stated in the Cancellation Policy.

3. Cancellation Policy

3.1 All cancellations must be submitted directly to the Company in writing and acknowledged by the Company.

3.2 Cancellation requests made to agents, third parties, or intermediaries are not valid unless confirmed in writing by the Company.

3.3 Cancellation fees are strictly enforced as follows:

30 days or more prior to the charter date:
→ 100% refund of payments received.

29 days or less prior to the charter date:
→ No refund under any circumstances.

3.4 The Client expressly agrees that this cancellation policy is fair, reasonable, and proportionate, and waives the right to dispute charges based on cancellation timing.

4. No-Show, Late Arrival & Early Termination

4.1 Failure to arrive on time, no-shows, or voluntary early termination of the charter shall result in no refund.

4.2 These situations do not constitute non-delivery of service under card network rules.

5. Use of Agents & Intermediaries

5.1 Agents act solely as intermediaries and have no authority to:

Modify bookings;

Accept cancellations;

Authorize refunds.

5.2 The Company is not responsible for:

Agent misrepresentation;

Failure of agents to pass on cancellation requests;

Unauthorized use of the charter by agents or third parties.

5.3 Any dispute arising from agent conduct does not constitute grounds for a chargeback against the Company.

6. Weather, Safety & Operational Changes

6.1 The Captain has absolute discretion regarding safety, routing, and operation.

6.2 Modifications due to weather or safety do not constitute non-delivery of service.

6.3 Only cancellations initiated by the Company due to safety concerns may qualify for rescheduling or refund at the Company’s discretion.

7. Limitation of Liability & Indemnity

7.1 To the maximum extent permitted by law, the Company shall not be liable for:

Indirect or consequential losses;

Third-party actions;

Chargebacks arising from false or misleading claims.

7.2 The Client agrees to indemnify the Company against any losses, fees, or penalties arising from unjustified chargebacks or payment disputes.

8. Chargeback Acknowledgment & Waiver

8.1 The Client acknowledges that:

The service is a time-specific, perishable service;

Once the charter date has passed, the service is deemed fully delivered.

8.2 The Client expressly waives the right to initiate a chargeback for:

Cancellation within 29 days;

No-show or late arrival;

Agent-related disputes;

Alleged fraud where authorization was given.

9. Governing Law & Jurisdiction

9.1 These Terms are governed by the laws of [Thailand].

9.2 Exclusive jurisdiction lies with the courts of [Thailand].

10. Acceptance & Digital Evidence

10.1 Acceptance of these Terms may be evidenced by:

Payment confirmation;

Email or message acknowledgment;

Use of the service.

10.2 Electronic acceptance shall have the same legal effect as a handwritten signature.
